What is Domestic Violence?
Domestic violence involves any act of violence or threat of violence directed by one person against a person with whom he/she is or was in an intimate relationship. Domestic violence can also include any other crime against a person or property, including animals, that is used as a method of coercion, control, punishment, intimidation, or revenge when directed against a person with whom he/she is or was in an intimate relationship. Intimate relationship includes any current or former spouses or romantic partners of the person charged. Domestic violence does not result in a stand-alone charge in Colorado. It is used to enhance other crimes if committed pursuant to one of these definitions.

When a person is charged with a misdemeanor offense that is classified as an act of domestic violence and that person has been previously been convicted three times or more of offenses of domestic violence, the misdemeanor may be enhanced to a class 5 felony. It does not matter that the past domestic violence charges involved different victims.

A charge of domestic violence will carry the possible penalty of the underlying misdemeanor or felony, but also can include additional collateral consequences. A person convicted of an act of domestic violence could lose his or her right to possess a firearm, even if the underlying criminal conviction is a misdemeanor. The person also will be required to submit to a domestic violence evaluation and attend any recommended classes. Additionally, many state licensure boards in Colorado will consider a domestic violence conviction, even a misdemeanor, a disqualifying event for licensure or employment.
